Pedig a törvény szerint egy ilyen vizsgálatot éppen akkor folytathat le a bizottság, “ha valamely nemzetbiztonsági szolgálat jogszabályellenes vagy nem rendeltetésszerű működését észleli”, vagy ha ezeket jelzi az illetékes miniszternek, ám a miniszter vizsgálatával nem elégedett. A ténymegállapító vizsgálat során külön albizottság alakul, amely minden, az ügyben releváns irattal, adattal vagy egyéb információval rendelkező személyt, szervet vagy szervezetet közreműködésre kötelezhet, ideértve az adatszolgáltatást, a megjelenési és nyilatkozattételi kötelezettséget. Az egyébként, hogy a kormánypártok ódzkodnak a Pegasus-ügyben bizottsági üléstől vagy egy ténymegállapító vizsgálattól, arra utal, hogy takargatnivalójuk van.
